Terms of Service

These Terms of Service ("Terms") govern your access to and use of the websites, platforms and services provided by Armonika ("Armonika", "we", "us") — including Armonika Cloud, Armonika HYP and Armonika VDI (the "Services"). By accessing or using the Services, you agree to these Terms.

1. The Services

Armonika provides sovereign cloud infrastructure built and operated in Algeria, including compute, storage, networking and related managed services. Your data and workloads are hosted within Algerian territory and subject to Algerian law.

2. Accounts & eligibility

You must provide accurate information when creating an account and are responsible for safeguarding your credentials and for all activity under your account. You must have the legal capacity to enter into these Terms.

3. Acceptable use

You agree not to use the Services to host unlawful content, infringe third-party rights, distribute malware, send unsolicited bulk communications, attempt to gain unauthorized access to any system, or disrupt the integrity or performance of the Services. We may suspend resources that threaten the platform or other customers.

4. Fees & billing

Usage-based Services are billed according to the pricing shown at the time of use, in Algerian dinar (DZD). Where a prepaid wallet model applies, charges are deducted from your balance. Taxes apply where required by law. Fees are non-refundable except where required by applicable law.

5. Service availability

We work to keep the Services reliable and available, but they are provided on an "as available" basis. Any service-level commitments, where offered, are described in a separate service-level agreement.

6. Your data & privacy

You retain all rights to the data you upload. Our handling of personal data is described in our Privacy Policy. You are responsible for the lawfulness of the data you process using the Services.

7. Intellectual property

The Services, software, and Armonika brand are owned by Armonika and its licensors. These Terms grant you a limited, non-exclusive, non-transferable right to use the Services; no other rights are granted.

8. Limitation of liability

To the maximum extent permitted by law, Armonika shall not be liable for indirect, incidental or consequential damages, or for loss of profits or data, arising from your use of the Services. Our aggregate liability is limited to the amounts you paid for the Services in the three months preceding the claim.

9. Suspension & termination

You may stop using the Services at any time. We may suspend or terminate access for breach of these Terms, non-payment, or to comply with the law. On termination, your right to use the Services ends; we may delete associated data after a reasonable period.

10. Governing law

These Terms are governed by the laws of the People's Democratic Republic of Algeria. Disputes are subject to the competent courts of Algiers, without prejudice to any mandatory consumer protections.

11. Changes

We may update these Terms from time to time. Material changes will be reflected by updating the "Last updated" date above and, where appropriate, by notice. Continued use after changes constitutes acceptance.
